Pladis Privacy Policy

This Privacy Notice describes how pladis North America, Inc. (“pladis”) and its brands, including  Flipz and Turtles (collectively “pladis,” “we,” or “us”) collect and process personal data about you when you use our Websites and their contents (our “Websites”), how we collect, use, disclose, or otherwise process information about you. We may provide different or additional notices of our privacy practices for certain offerings, in which case those notices will supplement or replace the disclosures in this Privacy Notice. If you are a resident of California, Nebraska, or Texas, the Additional Disclosures for Residents in Certain States applies to you.

Notice of Collection of Personal Data

The data we may collect about you depends on how you interact with us. The categories of data that we may collect directly from you may include:

We also collect any information you choose to provide to us or pursuant to your consent or direction.  We generally do not collect information that is considered “sensitive” under state privacy laws, and we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you. We may also aggregate or deidentify personal information so that it can no longer be associated with an individual. We will maintain and use such information in deidentified form and not attempt to reidentify that information, except solely for the purpose of determining whether our deidentification process satisfies applicable law.

We obtain the categories of personal data listed above from the following categories of sources:

  • Directly from you.  For example, from forms you complete or products and services you purchase, or when you communicate with us.
  • Indirectly from you.  For example, from observing your actions on our Website or from information your computer or mobile device transmits when interacting with our Website.
  • Third parties. For example, we may obtain personal data from mail list providers or advertising partners. 

How We Use Data

We use the data we collect to improve our Websites, products, and services, and to deliver content that is relevant to your interests. We also use the data we collect to:

  • provide you with product information;
  • develop new products and services; 
  • send you marketing communications or contact you for your opinions on our company, products, services, or Websites;
  • deal with queries and complaints, and otherwise send you technical notices, security alerts, support messages, and other transactional or relationship messages;

  • create de-identified and aggregate data that cannot reasonably be linked to you.
  • comply with a legal obligation; or
  • for our own lawful interests or those of other organizations, provided your rights don’t override these.

Disclosure of Personal Data

We may disclose any of the categories of personal data described above with the following third parties in the following circumstances:

  • pladis group companies (“Affiliates”): We work closely with other companies within the pladis group and Yildiz Holdings. We may share certain data between and among pladis and our parents, affiliates, subsidiaries, and other companies under common control and ownership, including enquiries, concerns, or complaints with other pladis group companies, for recruitment, customer service, and internal reporting purposes.
  • Vendors and Service Providers We may make personal data available to our vendors, service providers, contractors, and consultants who perform services on our behalf, such as companies that assist us with web design, administration, and hosting providers to operate our brand and corporate Websites; vendors that help operate contests and sweepstakes; printing and delivery companies for personalization of communications; recruiters; and third parties that manage information systems on our behalf such as email, office software, customer services, and personnel.
  • Professional Advisors: We disclose personal data to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests
  • recruiters acting on our behalf.
  • Law enforcement agencies, courts, regulators, government authorities or other third parties: We share personal data with these parties where we are under a legal or regulatory obligation to do so, or otherwise to protect our rights or the rights of any third party.
  • To Protect the Rights of pladis and Others: We may disclose personal data if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of pladis, our users, the public, or others. 
  • Corporate Transactions: We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. Should such a sale or transfer occur, the third party will be subject to applicable data protection laws and obligations.
  • With Your Consent or at Your Direction: We make personal data available to third parties when we have your consent or you intentionally direct us to do so.

International Transfers

We are part of an international group of companies, and personal data may be transferred to, stored, and processed in the United States and other countries. When we make a restricted international transfer of personal data, we take steps to ensure that your personal data receives an adequate level of protection (by putting in place appropriate safeguards, such as contractual clauses) or ensure that we can rely on an appropriate derogation under data protection laws. 

Retention

We keep personal data for as long as necessary to carry out the purpose for which we originally collected it and for other business purposes explained in this Privacy Notice, including where we need to keep it to:

  • maintain business records for analysis and/or audit purposes;
  • comply with record retention obligations;
  • defend or bring legal claims; or
  • deal with queries or complaints you may have.

Sales, Sharing, and Targeted Advertising Activities

We do not “sell” or “share” personal information or use personal information for “targeted advertising” under state privacy laws. 

State Privacy Rights

You have certain rights regarding your personal data, including the rights to:

  • request access to your personal data (including in a portable and readily usable electronic format);
  • correct your inaccurate personal data; and
  • request that we delete your personal data.

You can designate an authorized agent to submit a privacy rights request on your behalf. We may ask authorized agents to submit proof of their authority to make a request. In some cases we may be required to contact the individual who is the subject of the request to verify his or her own identity or confirm the authorized agent has permission to submit the request. Appeals
